Terms of Service

1. Definitions

"Platform" means the BitBotster website, web application, API, and all related services. "User", "you" means any individual or entity accessing the Platform. "Bot" means an automated trading strategy deployed via the Platform. "Exchange" or "Broker" means any third-party trading venue connected through the Platform.

2. Eligibility

You must be at least 18 years of age and legally permitted to trade financial instruments in your jurisdiction. By using the Platform you represent and warrant that you meet these requirements. The Platform is not available to residents of jurisdictions where its use would be prohibited by applicable law.

3. Account Registration

You must provide accurate, current information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately via email if you suspect unauthorised access.

4. Platform Services

BitBotster provides technology infrastructure for automated trading. We do not provide financial, investment, or trading advice. The Platform executes instructions you configure; all trading decisions are yours. We are not a broker, exchange, or investment adviser.

5. Risk Disclosure

Trading financial instruments, including cryptocurrencies, forex, and equities, involves substantial risk of loss and is not appropriate for all investors. You may lose more than your initial investment. Past performance is not indicative of future results. You should only trade with capital you can afford to lose entirely.

Automated strategies may malfunction due to software errors, connectivity issues, exchange outages, or market conditions. BitBotster is not liable for losses arising from any such events.

6. API Keys and Exchange Connections

You grant BitBotster permission to interact with connected exchanges on your behalf using the API credentials you provide. You are responsible for the permissions granted on those API keys. We strongly recommend enabling withdrawal restrictions on any API keys provided to us. You may revoke access at any time.

7. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse-engineer, decompile, or copy the Platform
• Use the Platform to manipulate markets or engage in wash trading, spoofing, or other prohibited practices
• Circumvent rate limits, security measures, or access controls. Your IP and account might be blocked without further notice
• Resell or sublicense access to the Platform without written authorisation

8. Fees and Payment

Paid plans are billed monthly or annually as selected. Fees are non-refundable except where required by applicable law. We reserve the right to change pricing. Failure to pay on time may result in downgrade, suspension or termination of your account.

9. Intellectual Property

All intellectual property rights in the Platform, including software, designs, and documentation, belong to Automation Arts & Technologies Limited. Your use of the Platform does not grant you any ownership rights. You retain ownership of your trading data and strategy configurations.

10. Confidentiality

We treat your API keys, strategy configurations, and trading data as confidential and will not disclose them to third parties except as described in our Privacy Policy or as required by law.

Notwithstanding the foregoing, you grant us the right to display bot trading activity in anonymised, read-only form in the public showcase on our homepage and in aggregated platform statistics. Anonymisation removes bot and strategy names, user and account identifiers, account balances and absolute position sizes, so that displayed data cannot be attributed to you or your account. 11. Limitation of Liability

To the maximum extent permitted by applicable law, BitBotster shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, trading losses, or data loss. Our total liability to you for any claim shall not exceed the fees you paid in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Automation Arts & Technologies Limited and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or your trading activities.

13. Termination

We may suspend or terminate your account for material breach of these Terms, non-payment, or if required by law, with or without notice. You may terminate your account at any time through a request via email. Upon termination, your data will be retained as required by law and then deleted per our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Hong Kong SAR. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong, except that either party may seek injunctive relief in any jurisdiction. EU consumers retain rights under mandatory local consumer protection laws.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
